Qui Tam
The Miami area personal injury and government claim litigation boutique of Patino & Associates can assist you in bringing "false claim" (also known as "qui tam") cases in the name of the U.S. government. Provided by The False Claims Act, a private citizen (known as a "relator") who initiates an action can receive between 15% and 25% of any award or settlement amount. An individual must use an attorney in order to bring a qui tam action under the False Claims Act.
Typical false claim cases charge that the government has been cheated as a result of actions involving product overcharges, failure to perform a service, underpayment of money owed to the government, or product bait and switch.
A case can be brought on behalf of the Department of Defense, Department of Health and Human Services (DHHS), the Food and Drug Administration (FDA), Department of Education (DOE), and the Veterans' Administration (VA).
Cases involving Government Agencies
Mr. Patino represented the family of Isabel Menéndez Machado against the U.S. Coast Guard over wrongful death charges following a 2005 matter. In this case, a Coast Guard cutter off the coast of Florida stopped a Cuban immigrant boat carrying more than 30 Cuban migrants. Ms. Machado died from head injuries suffered when the boat was seized.
Mr. Patino represented 31 year old Cesar Augusto Rada, a 31 year old man known by the police to be suffering from a bi-polar disorder, after he was shot in the chest multiple times and killed by a Miami-Dade police officer. The shooting took place in front of Mr. Rada’s house, against a backdrop of the father’s pleas for the police to stop.
